By creating an account or submitting an intake form on PerformerVerify, you agree to these Terms & Conditions. If you do not agree, do not use the platform.
PerformerVerify is operated by Upscale Media LLC ("we", "us", "our").
PerformerVerify is a compliance and identity verification platform that enables adult content creators ("Creators") to collect, store, and manage identity documents and signed release agreements from performers ("Performers").
The platform provides:
You must be 18 years of age or older to use this platform in any capacity. By using PerformerVerify, you confirm that you are at least 18 years old.
Creators are responsible for ensuring that all performers whose data they collect are 18 or older and have provided valid government-issued ID confirming their age and identity.

The PerformerVerify platform, including its design, code, and branding, is owned by Upscale Media LLC. You may not copy, modify, or distribute any part of it without our written permission.
Identity documents and personal data you submit remain your property. You grant us a limited licence to store and process them for the purposes described in our Privacy Policy.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UPSCALE MEDIA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any information on the platform is accurate, complete, reliable, or current.
Compliance tool — not legal advice. PerformerVerify is a record-management and document-storage tool. Nothing on the platform constitutes legal advice. The 2257 compliance features, generated statements, PDF releases, and any other compliance-related functionality are provided as convenience tools only. We make no representation or warranty that use of these tools satisfies any legal obligation under 18 U.S.C. § 2257, 28 C.F.R. Part 75, or any other law. You are solely responsible for ensuring your legal compliance. We strongly recommend consulting qualified legal counsel regarding your obligations.
Document authenticity. We do not independently verify the authenticity of identity documents, certificates, or any other materials submitted through the platform. Creators are solely responsible for verifying that performers are who they claim to be and that documents are genuine.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UPSCALE MEDIA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
These exclusions apply regardless of the theory of liability — whether in contract, tort (including negligence), strict liability, or otherwise — even if we have been advised of the possibility of such damages.
Liability cap. To the extent any liability is found notwithstanding the above, our total aggregate liability to you for all claims arising out of or relating to the platform shall not exceed the greater of: (a) the total subscription fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Upscale Media LLC, its officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
We may suspend or terminate your account at any time for breach of these terms. You may close your account at any time via the Privacy tab in your dashboard.
Upon termination, your data will be handled in accordance with our Privacy Policy and applicable law. Termination does not relieve you of any indemnification obligations or liability that arose before termination.
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
We may update these terms from time to time. We will notify you of material changes by email. Continued use of the platform after changes constitutes acceptance of the updated terms.
